What are the steps to issue a Subpoena Duces Tecum for Medical records in New York?

There are 2 ways. You can either prepare the subpoena and serve it on the doctor with copies to all parties and paying the doctor the fee for the records. The second way, if the doctor doesnt want to comply, is having a judicial subpoena signed by the judge directing them to comply and again paying the appropriate fee for the records. You have to serve the judicial subpoena on all parties.

Normally, an authorization signed by the patient is required to accompany the subpoena.
