You can file an I-130 petition for her right away if you're a U.S. citizen or legal permanent resident (green-card holder). However, whether she could continue and finalize her papers to get a green card depends on whether she came here legally or illegally, and whether you're a citizen or not. You should write back and explain in more detail. Depending on the facts, it could be quite easy or quite difficult for her to be legal, and it could be a matter of less than a year to several years of waiting.

You can petition for your wife right away, unless there are some problems not mentioned in your question, but the waiting time depends on whether you are a U.S. Citizen or not.

However, you can apply for your wife anytime you wish. Is she already in the country?
