Arm broken at resort in Dominican Republic

On 8/28 upper right arm broken at humurus with nerve damages. Fingers numb and cannot move wrist with limited movement in fingers. Surgeon recommend surgery, but MRI result shows nerves are stretched out of place. Can i file claim from NY? Resort operate hotel in Miami only. i was tricked into participating in the arm restling organized by the hotel staff. The instructor asked all the guests in the pool who participated in the water aerobics to sit on the edge of the pool. the instructor lifted us one at a time to sit on the chairs (approx 10-12) that were brought to the pool area. the did a demonstration in Spanish and saw that the game was arm wrestling. they later asked for additional volunteers. Staff did not warn of danger of participating in the arm wrestling event. I live in NYC and accident happen in Dominican Republic. Do I have case? Hotel did not want to pay hospital bill in Dominican Republic. They gave us voucher for another vacation but it reads if we accept we could not file claim with insurance Co. I am in so much pain still.

I'm admitted in NY and FL, but I don't do much Personal Injury work. You probably need to consult with a PI attorney in Miami. I don't see much chance of you being able to sue in NY and I would have to research this to have a better idea of your chances of successfully suing the resort in Miami.
