Legal Question in Employment Law in New York

Hello to You,

I don't now what to do about this:

I was hired as an Independent Contractor back in later Feb. I signed an NDA, filled out an ACH Authorization & 1099. The CEO of my company hasn't paid me for work I've completed between March and April. There were rumors that he wasn't going to pay us, as another Rep from another state (who was supposed to be a friend of the CEO) was ready to file a suit for lack of being paid his $25K in commissions. I am currently owed around $2K. The CEO has a contract with the Dept of Defense, I think about reaching out to them but am afraid because of the NDA which states full jurisdiction of the state it was created in, NOT my state. I am so broke, can barely eat so I can't even think of legal fees. This is my first time placing this issue in the front of an experienced attorney, thank God the Answer is complimentary. I'm seriously at a stand still about this situation. This guy has taken a lot in commissions and he is still carrying on his business, knowingly not paying the Reps what they are do. He is currently under some new partnership with a Christian Radio station! ANY guidance at this point is appreciated and grateful. I am in NY state.

Likely the most efficient course of action would be to file a law suit against your boss at your local small claims court. You do not need an attorney and the filing fee is very little. Sometimes they wave the fee if you bring proof that you are unable to pay. The clerk of the court can help you fill the form. Often there are volunteers that help as well.

Good luck
