i have a retail store and i saw one of my employees kicking the merchandise with his foot on the flor and saying its garbage
do we have the right to fire him
from the job

Generally speaking, NY state is an "at will" employment state which means you can hire and fire anyone at any time and for any reason (or no reason) provided it's not discriminatory. Some other exceptions.exist as well.
