Legal Question in Employment Law in New York

My union refused to take my greivance to arbitration because out of 5 employees, I was the olny one refusing to come back to work after the the company agreed to issue back pay then on the day we returned to work they changed thier mind and refuse to give us back pay.

The union also allowed the negotiating to carry on for over 4 months

Since then the union does not reply to my letters or calls.

Do I have a lawsuit against the union.

Do I have a lawsuit against the company.

Do you have the money to pay your lawyer(s)? Do you have another job. If an employer violates a contract you grieve. You don't withold your services.
