Legal Question in Landlord & Tenant Law in New York

My landlord has rented to some real doozys. At the current time, I am living below two people that just had a baby and NEVER let their dog outside. They threw out two huge bags of garbage from upstairs that had dog feces in it wrapped in paper towel. Not to mention the fact that every Sat it is left alone from 9:30pm til 730am barking non-stop. I also have bad windows, one of which I broke a finger on last year and had to have surgery, a moldy basement and leaky ceilings from the plumbing upstairs. I basically have a slumlord. My main concern is for mine and my childrens health with the dog defecating upstairs in the house, and the mold in the basement below. I can guarantee if I push these issues hes going to raise my rent and look at me as a trouble maker..Whenever I address issues, he will throw the cost of my electric bill(HE PAYS) in my face, yet not one repair ever gets made. Can I get a lawyer? I wish I had sued when I got surgery on my finger yet I know he will put me through hell if I raise these issues and make me feel bad. Please help..we have been sick alot in the past 7 years living here.

Why would you want to stay in this property.

The dog is one thing, but the mold is another. You never get rid of mold, it just comes back unless the moisture os taking away.

For the sake of the children you should move.

But you can also call the health department, without giving your name and complain. But he most certainly will think its you.

Once you move out you can caln start a lawsuit for your finger.
