Legal Question in Landlord & Tenant Law in New York

I am leasing a house for a year and i am subletting it to this guy.

He paid $500 for security and $500 for the first month

It is now August, and he refuses to pay rent and we want to evict him.

He said he isn't leaving until he gets his $500 dollars back but he made a hole in our wall and stayed for 13 days in this month.

I told him that if he doesn't move out, I will put his stuff on the curbs and he threatened me.

What is your question?

Do not put his stuff on the curb. You need to evict him legally through the courts.

It does not pay to threaten or retaliate against the tenant. You would need to a summary proceeding to evict.
