Legal Question in Landlord & Tenant Law in New York

We moved into our apartment 4 months ago and just found out that he was a registered sex offender. If we would have known that before we wouldn't have rented the house because we have a 1 year old daughter. Is there anything we can do?

You always of the option of asking the landlord's consent to release you from your obligations. However, based solely on the facts set forth in your question, there is nothing you can do.

Your question is confusing because you didn't disclose who the sex offender is and what type of apartment have you rented? Is the sex offender the landlord or a tenant? In any event, you should check to determine if there are limits to his release regarding residing near children. Moreover, does the landlord know that he is renting to a sex offender? He may evict the offender because it is "bad for business."
