Legal Question in Landlord & Tenant Law in New York

rented a room

I rented a room and had the tenant sign a lease for one month, just to try him out. He move in Jan 15, 08, and the paper expired feb 15, 08. one week before the expiration the tenant didn't pay. then when i told him to leave, he told me to give him a week to look for a place to move. then he paid me. I accepted the money and told him to move, but we are in May and he hasn't move or is not planning to, and he is not paing either. Can i lock him out or call the cops on him to take him out? Does the eviction process also applies to people who rents out rooms not an apartment?

Re: rented a room

No you cannot lock him out. The police will not take him out. The eviction process also applies to people who rent out rooms.
