Legal Question in Landlord & Tenant Law in New York

Security Deposit to Hold, Landlord Backed Out

We put down a security deposit to hold a property, after which we would pay the first month's rent on the first to move in. 3 days afterwards, the Landlord sold the house and told us we can't move in, she would return the security. Problem, however, lies in the fact that the apartment we currently reside in has already been rented as of the first. Is this legal, is there anything I can do about it? This leaves me less than twenty days to find a new residence, and I have children.
