Ethical Behavior by an Attorney

I am trying to get my attorney to return the $70,000 I paid him when I hired him. I am an immigrant. He was hired to work on an appeal for a criminal case. It's been over a year, and he has missed the deadline for the appeal (or motion, not sure exactly which). Further, my attorney and I never met in his office. We always met at a steak restaurant where he expected me to purchase him dinner. I believe that the paperwork alone will show that he did not work enough to warrant him keeping a quarter of the entire money which I paid him. He has refused to return the money. What recourse do I now have?

The only option would be to initiate a law suit for the return of the unused posrtion of the legal fee.
