Legal Question in Legal Malpractice in New York

Attorney malpractice?

Hi,I have a situation where i thought I was being represented by a attorney...I was referred to him by a attorney of my associates and I...I faxed over the Judge's ruling..He read it...and asked me to come in to his office...Once there he briefly interviewed me...and asked me to sign some paper work..the claim was originally set for 5,000,000$..i had only 2years to file this claim..the incident happened in 2004..he picked up my case early 2005..I would call him once a month..And he told me that he sent it over (to the courts i guess?) and that they received it..(i guess he sent it through certified mail?)..recently i noticed that he was not answering, returning my phonecalls or emails..I, was not happy with the way he was treating me or representing me..So,i had another attorney call him up to see what is going on?he told that attorney that he never represented me! that he only was going to look into the case! this is so false! Now, the time limit for the claim has expired! and i have lost this opportunity..Can i now follow through with action against him now for false representation, and attorney malpractice?

Re: Attorney malpractice?

It's possible. However, there are several hurdles to overcome before such a case could be brought, and further hurdles before it could be sucessfully concluded. If you would like to arrange a consultation, please feel free to get in touch.

Re: Attorney malpractice?

You may have a case but it will depend on what type of case you originally had... you need to prove that but for the attorney's negligence, you would have won your case. So it really depends on the strength of the original case. I handle legal malpractice cases so please feel free to contact me.
