Legal Question in Medical Malpractice in New York

I'm looking for a medical malpractice lawyer because my neurosurgeon sent me home with an infection in my neck, and then after 2 life saving surgeries and vancomycin put the wound vac on wrong and wouldn't of known except I knew I was still dying so I went to a wound dr and saved my own life. This happened last March but I am about to have more surgery because the enormous scar needs more care. There is much more because I want to sue the hospital and first round of at home nurses I fired too. It's a long story, but my question is did I have to get a 90 day claim in last year? Or am I safe?

Has any doctor said that the first doctor was negligent? The Notice of Claim requirement applies to a municipal/city hospital or doctor (meaning the doctor is a hospital employee rather than having privledges).
