Legal Question in Personal Injury in New York

My 4yr old son was burned (2nd & 3rd degree) at--name removed--campsite. He fell into--name removed--fire pit that had not been extinguished by another camper and/or the camsite owners. What is my recourse in taking care of payment of medical bills as well as getting the campsite to protect other campers from getting Burned?

This is terrible! I hope your son will not bear any scars. I am a regular camper myself and I like to think I am very careful with fire. I would hate it if my carelessness hurt someone else like that. my last trip was in Canada.

The legal question is difficult to answer without more information. For example, if the firepit was on a hiking trail I do not believe that the owner/manager will be held liable. On the other hand, if this is a drive-in campsite the owner will be held liable.

Of course, the insurance company will likely pay you compensation under both circumstances. So my advice is to speak with a solid attorney with whom you feel comfortable and discuss with him the injuries and hurt that your son has suffered.

Money cannot make the hurt go away, but it does make it easier to live with. 2nd degree burns in many bodily places will not produce a scar. So being able to promise your son a trip to Disneyland or Cooperstown may give him something to look forward to and make the pain easier to bear.

I'm sorry to hear about your son. From the facts that you've given it sounds like there is a good chance that the accident was in fact the camp's fault.

In order to fully evaluate your son's claim I would need further information such as the set-up of the campsite, the number of people supervising the children, etc.
