One month and no accident report from the police

My wife and children were in a car accident about a month ago. A week after the accident we attempted to get a accident report from the police but they told us to come back in two days Two days past and they still did not have the report. In fact, there was no record of the accident in the computer. The following week we returned, they now said that the officer who they thought responded was not the officer because they had a party the day of the accident and task force was covering for them, so it was someone from task force. Its been a month and still we are not getting cooperation from the police. They have no record of the accident and they claim not to know who responded to the accident. Its possible that the officer lost the information and they are covering up for him. Can I sue the police department for their negligence?

You don't say whether you obtained the other driver's information independently. If so, you have the information you need to make a claim. That there is no police report is odd, but not fatal to a case. Presumably you reported this accident to your insurance carrier. Has the carrier had any success getting the police report? They will work with you. You will not be able to sue the Police Department, even if they negligently botched the reporting of this accident. Best, M. E. Zuller
