Legal Question in Personal Injury in New York

Personal Injury Claim

I am 18 years old, and my passenger is injured in an accident. If they file a lawsuit against me, and my insurance cannot cover the full cost, can my parents or their insurance company be held accountable, or be purused legally in any way? Assume Scenario 1: I am a commuting college student living at home with parents.

Scenario 2: I am a High School Student living with parents.

First, your passenger will have to have sustained a "serious injury" under NY No Fault laws and/or have more than $50,000 in medical bills before he can sue anyone.

Next, it depends on whether the car was in your name or your parents.

If in their name, they will be sued and their insurance co will need to defend the suit and/or pay damages.
