Legal Question in Personal Injury in New York

we have a situation where family is divided over insurance money received for a fire. Brothers were talking and sister from over 60 miles away called 911 because of wife ordered inside. Sheriff and state police arrived and said obviously nothing was disturbed and were reporting it as a mistaken 91 call and left. Day later one brother found out the wife of the other is telling people he had a shotgun and other misc lies. Can he sue for defamation of character?
