Legal Question in Personal Injury in New York

Can I sue Fordham University?

Hi. im a college student in the nyc area... I was given the oppertunity to participate in a scientific research facility in Armonk NY, run by Fordham University, I got a stipend from the Nactional science foundation to study ticks. One of the buildings on this property was a 70 yr old wooden lodge. this past summer while i was walking down this lodge i got a splinter from the wooden hand railing that was never really sanded. part of the splinter broke in my hand, and it went in soo deep that no one could take it out. The president of the louis calder center told me that i had to go to the hospital and that they would pay for it if i had no insurance(i did not) After the docter performed exploritoy surgery, he took out a one inch splinter that damaged nerve tendons on two fingers that were unable to move. he saw that it was infected and i stayed in the hospital for 3 days on a antibiotic drip. now my fingers can move but have some perminent numbness and after 5 months. Fordham has not payed my bills can i sue? I hope you are not a Fordham Law graduate

Re: Can I sue Fordham University?

The answer is a definite "maybe". I suspect you had to sign something before participating in the study. I would like to see what you signed before giving you a definite answer, although I would be willing to bet that whatever you signed would not prevent you from bringing a lawsuit. My advice is go see a lawyer specializing in personal injury. Bring any document you have with you, even if you are not sure it is important. Good luck.

Re: Can I sue Fordham University?

There are a few things that need to be checked, but there is a probability that you have a right to sue for your medical expenses AND for your pain and suffering.

You should contact a lawyer to evaluate your case.

It is very likely that you have a viable claim against the university and nobody at my firm ever attended Fordham.

We have substantial experience handling these types of cases, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.

Re: Can I sue Fordham University?

Are you still under the care of a doctor?

Are you able to use your hand to perform tasks as you did prior to this accident?

Did you fill out an accident report?

You can give my colleague Tom Annunziato a call to discuss the possibility of legal action.

My number is listed on my website.

Sincerely,

Patricia Martin-Gibbons, Esq.

Re: Can I sue Fordham University?

Possibly, you have a claim against Fordham Univ. It may depend on whether you have "employee" status as a participant in your research program and who, or what, is the titled owner to the property. Things to discuss here. Best, M. E. Zuller
