Legal Question in Real Estate Law in New York

Children want to sell house

My 6 siblings all owned a house deeded to us by our parents after they divorced in 1977. My mother has lived there since. Four of us children all over 18 and living elsewhere have since deeded our shares of the property house and 10 acres to our mother. Now to siblings both 0ver 18 living else where want to sell the property and force my mother out. My mother wants to remain in the house and does not wish to sell or can not buy the other 2 out. What can she do to retain possession? Also what can the other 2 siblings who share ownership do to force a sale against my mothers wishes?

The exact status of the "mode" of ownership governs this situation. However, assuming the most common status in situations such as this, your siblings would have to commence an action in court to force a sale that would affect your mother's rights.
