Legal Question in Real Estate Law in New York

The closing date in the contract for the sale of my NYC coop was "on or about 15 July." The buyer kept it secret and announced a few days before the closing a 21 day trip to China, returning on 03 August. Is the buyer in default of the contract by his absence because of the "on or about 15 July" closing date?

Without seeing the entire contract, it's impossible to tell, but it's unlikely that you can bust the contract and keep the downpayment. Why are you asking here instead of asking your lawyer?
