Legal Question in Real Estate Law in New York

Driveway dispute

A driveway that is ''shared'' with the new neighbors next door is on my property also. It leads to my garage and we have been using the driveway for 40 years. I am now being told by the owners and their lawyer I am not allowed to use it anymore. I need help, but cant afford a lawyer.

Re: Driveway dispute

If you have used this driveway for 40 years you may have established an easement (a legal interest).

If you used this driveway without the former owner's permission and as if it belonged to you (maintainng it, etc.)you may have a claim for adverse possession (actually owning it).

But, the above is just a simple summary. There is alot more involved.

You need an attorney. Loss of the driveway use could effect your property value never mind the inconvenience BUT you will need an attorney as this is not a simple matter to resolve.
