Legal Question in Real Estate Law in New York

please explain, language on deed?

I had posted a question about my wanting to partition property and in the response it said, ''As an owner - depending on the language in the deed - you would have the right to partition.''

What language in the deed? I really want out of this house. I am on Social Security Disability and I want to move out. I can only have one residence. I can't be on the deed to one house and live in another. I need to partition.

Re: please explain, language on deed?

If the deed says that you waive or do not have the right to partition, then you do not have the right to partition. If the deed has no language concerning partition, then you would have the right to partition.

Of course, I would have to read the deed to confirm the above.

Mike.
