Legal Question in Real Estate Law in New York

Hello,

I am a co-owner of a piece of land. We are three owners in total. One of the owners has been working in the land for the past 10 years. I heard that there is this law that states that if someone uses the land for a specific period of time, that person gets ownership of that land. In this case, since only one of the owners has used the land, will the land become his after a period of time? If yes, what can I do to not allow this to happen?

Thank you!

The best approach is to have all owners sign an agreement to the effect that tne one who is on the land is doing so with the others' permission. In order to claim title by use, the claimant's use has to be hostile, or "adverse." I would record the agreement with the county clerk to make sure the world is on notice.
