Legal Question in Real Estate Law in New York

House

I bought a house with an ex-spouse as a business partner. Both are names are on the original deed. Then we re-mortgaged the house at a lower rate.

I had to leave the house because my ex-spouse became an alcoholic and abusive.

When I signed the refinancing paperwork, my ex-spouse told me that my name is not on the deed anymore and I have no claim to the house.

Is this true?

Re: House

If your name was on the deed, you have to sign a new deed to get you off...in other words, all owners MUST sign when any changes to the deed are made. Further, on refinancing, the lender will usually require ALL owners to sign the mortgage, if even they do not sign the note. NOW this info is only for the real property aspects and not for any matrimonial concerns that may be implicated by your question.
