Legal Question in Real Estate Law in New York

I'm living in an apartment in NY. I am under a rental agreement and not a lease. Before I moved in I payed two months security deposit for a term of September 2009 to August 2010. Is m landlord able to keep any of my deposit if I decide to move out in June instead?

If you break your lease and the landlord does not re-rent for the same amount then yes, he can take your deposit to cover his loss.
