Legal Question in Real Estate Law in New York

We are being sued by a prior landlord for damage to the house and theft of appliances. The house is in Westchester, NY and the complaint was filed in Putnam County. The plaintiff resides in Putnam. Shoudl they have filed in Westchester?

The law allows a transitory action, like this, to be filed in any county. You may have grounds to kick the case back to Westchester.
