Legal Question in Real Estate Law in New York

New York - Long Island: first time home buyer, wanting to make an offer on a short sale. Broker wants me to sign a 'Sales agreement' that has a comment about being 'legally enforcable contract' before submitting the offer... Is this common practice? Spoke to the broker over the phone and he said it's not really a contract. A formal contract would be written once the offer would be accepted. Somewhat confusing and contradictory...

I would not do it. It sounds like the broker wants you to submit a binding offer...which instantly becomes a contract when the seller says "yes." Make sure the offer has attached to it a pro-buyer contract that is part of the offer...that way, if the seller accepts it you are protected.

The nroker sounds slimier than most to me.
