Legal Question in Social Security Law in New York

Can a person work part-time while receiving social security disability benefits?

If one is receiving social security disability benefits is there a maximum income they can earn without it affecting the disability benefit?

In order to be eligible for Social Security Disability Benefits you must meet many factors. However, one factor is that you cannot perform "substantial gainful activity (SGA)" which I believe is defined as earning more than $1000 a month this year (or $1640 if you are blind).

Therefore you could possibly earn that amount of money and not lose your benefits. However, Social Security may still re-look at your case to determine your disability.

Finally Social Security does allow for a period of work known as a trial work period where you can earn more than the SGA but after nine months or sooner will cease your benefits.

Take a look at my site www.markhofflaw.com or www.socialsecurity.gov. Good luck!
