Legal Question in Traffic Law in New York

Rights of deployed military in civil court cases

My husband received a traffic ticket shortly before he was deployed to Iraq. He was unable to deal with the charges before he left and the court is threatening to suspend his license and add other charges. They have told me to forge his signature if i want to make the charges go away. What can i do? Does the Servicemembers Civil Relief Act apply?

Who is the "they" who supposedly told you to forge his signature???????

DO NOT FORGE THE SIGNATURE. Forgery is a serious crime.

You asked about responding to charges regarding a traffic offense for a deployed soldier.

DO NOT FORGE HIS SIGNATURE.

There are legal ways to sign documents without creating a large legal problem.

But you should speak with a prosecuting attorney and not simply a clerk handling consumer inquiries. But you must handle this. If it goes to default then it could affect the soldier's career. Even for a minor matter.

It actually may be best to hire an attorney to handle this matter, but know what to expect ahead of time.

Good luck.

Roger
