Legal Question in Traffic Law in New York

Speeding with a broken speedometer

I was pulled over for speeding at night, an 1180d, speeding in a posted zone. However I explained to the officer that my dashboard lights were not working. It was a condition that happened when I put on my headlights, therefore I did not know how fast I was going because I could not see the speedometer. Is there any action I can take to fight this ticket?

Re: Speeding with a broken speedometer

The answer is, don;t speed. The reason you were speeding was your fault...your equipment did not function and you made no effort to correct it, so lets forget that approach.

If this is your first offense, and depending on the speed excess, perhaps the officer/trooper will let you plead to failure to obey a traffic control device ( the posted speed sign). It will be a fine + a surcharge but no points.

Good Luck
