Legal Question in Workers Comp in New York

new case

i have a permanent partial disability since 1994, i am receiving 270 a week my average weekly wage is 864. got a new job making 400 per week gross.i fell at my new job and damaged my knee..can i receive benefits from my new job even if i am receiving benefits from my old case? please leave your phone number i don't have a lawyer yet...thanks

There will be an apportionment between your prior injury and your new injury. There will be two carriers and it may be complicated. You should get your treating physician to immediately opine whether your current condition is an aggravation of a prior injury or it is a fresh injury. Your rate and the amount of money that you recieve depend on the doctor's answer. Of course, both insurance companies will want to have you examined as well.
