Legal Question in Workers Comp in New York

i am an Iraq war Veteran and a Firefighter on the civilian side. i have been harassed to to the point the V.A. wrote me out of work while i have been getting treated because my symptoms have been exasserbated by my Chief. i have much proof of this and can obtain statements by co workers and board members of my union. i received a letter the City was going to terminate me Jan 20th. i consulted council that has written a letter on my behalf for a hearing. i am worried the hearing will not be an unbiased ear. also am i protected under the patriot act? i have letters from psychologists saying i has ptsd but could do my job and the chief wouldnt let me work kept me on light duty and kept sending me to the city DR. who would undermine any other DR i havnt worked since feb 2009 and was told by my union president that Chief said he wouldnt leave me alone ever and i would never have a shot of keeping my job. now three years of this i have been hospitalized and been in inpatient PTSD programs am on anxiety and depression meds and really cant go back to a hasty work environment. So basically i have a road map of this Chief pushing me over the edge. can the city fire me without some kind of retirement compensation? i have three young children and a fourth due tomorrow i'm very scared and frustrated i dont trust anyone in my corrupt political city.

Don't fret. You have employment rights that are protected under the ADA and USSERA. Get to an employment law attorney fast and before your hearing. When you speak to the employment law attorney mention the term "collateral estopple" on a claim raised in an administrative hearing as a bar to future federal court litigation. Keep fighting!
