Legal Question in Bankruptcy in North Carolina

Options

I have been in a chapter 13 bankruptcy for about 12 months now and am having a hard time paying now that my wife is on a permanent leave of absence from work. Can I reorganize or convert to chapter 7 at any time or do I have to pay on chapter 13 for an amount of time?

I really need advice on this.

Thanks

Re: Options

First...contact the legal counsel who prepared your initial filing. . .they can assist you in amending and converting to a Chapter 7. Obviously your 13 filing was prepared based upon anticipated future income; if that has changed permanently, you need to adjust your Petition before you fail under the 13 proposal. Good luck.
