No Address for Defendant

I'm trying to claim money that is owed to me in the sale of a motorcycle. I would like to file a small claims case against someone in North Carolina that is always moving around and I don't have an address for them. This person's mother lives in Maryland and I know that sometimes this person stays there. I have this address in Maryland. Can I use the Maryland address for the case in North Carolina or do I have to sue in Maryland even though the events of the case didn't take place in Maryland?

If the sale took place in NC, you could sue him in NC. Your issue is going to be serving him b/c until he is served, the complaint can't proceed. Additionally, small claims court has specific rules about suing the Defendant in the County where the Defendant resides. You may need to sue in district court.
