I live in NC. i have had a suit filed against me and a judgement issued against me from Discover card ''after the 3 yr statue of limitationswas up ''.Question Can i have it dismised because of the staue of limitations was past ? Do i have to wait 5 yrs before the judgement's statue of limitations is over? Can the judgement be renewed after the 5 yrs statue of limitations ? what is your advice? thank you Rich

I don't fully understand your question. If you had a statute of limitations defense, you should have raised it when you were sued. Once they got a judgment, you may have waived your defense. You can check with a litigation attorney.

Otherwise, I am unaware of a statute of limitations on judgments. They last for 10 years but can be renewed at that time if the Creditor wants.
