Legal Question in Credit and Debt Law in North Carolina

Our landscaper in nc has not billed us for seven years despite our numerous requests for same. What is our legal obligation to him? Are there any statute of limitations regarding billing us now for so many years? How far back are we responsible for payment? This is causing a drawback to the sale of the house.

Statute of limitations in NC is 3 years for most simple contracts. So if he sued today, the farthest he could go back would be July 19, 2013 so you have no legally enforceable option beyond that. I would have to wonder how he stays in business if he has cut your grass for 7 years and you have never paid him a dime. I also wonder why he never made a demand for payment or why you permitted him to continue to cut grass after he refused to issue you a statement.0

What do you think is fair and reasonable for his actions? Grass cutting season at most lasts from May to October roughly.. What would be a fair price? Maybe you determine what a reasonable cost would be for the past 3 years and offer that to him and tell him that his services are no longer needed. And it would help to get something signed by him that if he accepts nothing further is owed.

I am not sure why this would be causing a drawback to the sale of the home. The new buyr would not be liable. There are no judgments or liens.
