Legal Question in Credit and Debt Law in North Carolina

Loan Refunded, Creditor still trying to collect

I had enrolled in school for IT classes. Lost my job and then followed procedure for un-enrolling from class. Requested for refund of financial assistance. Refund granted and documented. Financial institution continues to aggressively try to collect balance. All parties have been provided with copies of documentation proving that refund was granted.

For three years financial institution has been trying to collect these funds and have reported against my credit that I failed to pay back the loan. The loan was refunded. There was nothing to pay back.

Would like to pursue claim against financial institution for wrongfully reporting against my credit.

Do I have a claim? Do I have grounds to file against financial institution?

Re: Loan Refunded, Creditor still trying to collect

You may have a valid claim, but there are a few things that would have an effect upon whether you have a claim, and how good it might be. Were there fees and earned interest remaining that were not paid by the refund? Is the financial institution the lender or a guarantor of the loan? Were you billed for the loan after the refund? Did you dispute the debt in wirting, if you were billed?

You should have a qualified attorney review all relevant documentation as soon as possible. Your statute of limitation has run or may run soon on part or all of your potential claims.
