Legal Question in Criminal Law in North Carolina

If I bet the coach that my daughter is an above average batter on the softball team....I say put her on the batting lineup for the rest of the season. If her batting average is not above the team average then I donate 1000 dollars to the school....if her average is above, then we shake hands and part ways. Legal or illegal?

Neither. This is a gentleman's bet and does not rise to the level of a contract for several reasons but most notably because there is no quid pro quo or consideration basis to form a contract. As such it's enforceability rests on the strength of the word of the individuals involved. Nor is this illegal as far as I can tell. It is however, a nifty and somewhat clever way to sidestep something that may be illegal or at least a violation of school policy and that would be outright buying your daughter a position in the batting lineup.
