Legal Question in DUI Law in North Carolina

I recently wrecked my SUV on a dangerous unmarked curve on a road that I had never been on. After the police arrived I was given 3 field breathalyzer which the officer said I passed all 3. I was then given a field sobriety test after which I was placed under arrest for a DWI, even though I believe I performed well on the test. At the station I was given another breathalyzer and blew a .07. The legal limit in NC is a .08. I was charged by the officer with driving while subject to an impaired substance. I was allowed to keep my license and cut loose that night. My question is can I be charged with a DWI even if I am under the legal limit. Also would a lawyer be able to get these charges reduced or dropped so i don't have a DWI on my record?
