Legal Question in Elder Law in North Carolina

Termination of power of attorney

A disinterested distant family member is trying to remove power of attorney rights from a trusted long time family friend for an elderly lady by the accusation of misappropriation of funds. The family member is calling for a competency hearing for the lady before proving the accusation. What can the friend do to protect herself and what recourse does she have?

Re: Termination of power of attorney

The friend simply needs to show that she did not misappropriate the funds. She should hire a lawyer and, assuming she has been acting in good faith, I see no reason she cannot use the elderly lady's funds to pay the attorney. If she cannot locate good, local legal representation on this site, I recommend that she also look at the directory at www.elderlawanswers.com.
