Legal Question in Family Law in North Carolina

Child custody

My finace and I are trying to get custody of his 5 yr old daughter. We found out that she was taken from her mother the day that we were in child support court because of his latr payments. We read that she was removed from the mothers care because she was neglected and also that the mother was involuntarily committed because of a bipolar disorder. My fiance was never contacted about anything until his daughter was in foster care. Now we are fighting the aunt (the mothers sister with whom the mother and child lived with) and the department of social services (DSS) to get the child back. DSS has not been pleasant to work with, because they keep alleging that my fiance has not seen her in 2-5 years. He saw her last, in March 2004 and would call her periodically. We have also just learned that since he was not married to the mother now he has to take a paternity test (his name is on the birth certificate). We have a court appointed laywer who seems very disinterested in our cause and we are very upset that DSS put this child in this situation. She has a parent who was willing to take her but was never contacted. How can we get her out NOW, without going throught the long process. DSS was wrong and we have no recource or help. HELP!

Re: Child custody

She is in the system now. You will either have to retain an attorney and push DSS and the courts or you will have to urge your appointed attorney to do so. There is no quick easy when dealing with DSS.

Good luck
