Legal Question in Family Law in North Carolina

I live in North Carolina. I found out my wife was having an affair and our 1 month old infant was not mine. Can I kick her out of the house based on her adultery?

You are asking the wrong question. The answer to the question you asked is - depends. It depends on what you mean by 'kick her out'. If you mean can you physically grab her and toss her out on her butt - sure you can try it if you are physically strong enough but you will likely get into trouble. However, I suspect what you actually meant to ask is 'can I legally kick her out' - the answer to that question is no you can not legally physically toss her out of the house. If you want her out legally, you'll have to either convince her to leave on her own or you'd need to file a divorce from bed and board and petition the Court to put her out.
