Legal Question in Family Law in North Carolina

my sons father and I are not married never was. we have no special custody provisions we share equal custody. but I have physical custody. he pays $72 biweekly for support, ordered by the judge. My son has severe asthma and although I make more money than him, he did add him to his job insurance, and now wants me to pay for his insurance. All the many years Ive had to support our son alone with no financial help from him, I feel that he should pay child support and continue to keep him on his insurance. To add him to mine is extremely expensive. I live in NC and want to know when we go to court over this who will have to pay for his insurance

The best way to handle it is to work it out yourselves. If you can't, then you need to weight the cost versus the benefit of hiring an attorney and going to Court. However, child support is a simple thing to calculate by guidelines based on income, You are likely not going to squeeze much more out of someone who's financial status is low enough to merit an order of a mere $72 bi-weekly. If you do opt to go the Court route, you need to consider being consistent in your statements. If you say "he pays $72 biweekly for support" in one sentence and then say "I've had to support our son alone with no financial help from him" in another as you have done here - a Judge will likely have a difficult time believing you and it will make proving your case harder. Best of luck.
