Legal Question in Family Law in North Carolina

student loan repayment

My son's wife left him the week after she graduated from graduate school. Will he be responsible for her student loans. They don't have children or a house. Only some bills.

Re: student loan repayment

Generally assets that are acquired between date of marriage and date of separation are marital (there are some exceptions). But debts acquired between DOM and DOS are presumed to be separate. A student loan is generally treated as a separate debt BUT funds paid in excess of tuition and fees as a refund that were used for family purposes could be treated as marital.
