Legal Question in Civil Litigation in North Carolina

I am affiliated with a small sports related non-profit in my community. Someone who is not an officer and not affiliated with the organization, made an unauthorized purchase in the name of the organization. The purchase was billed to our league. This purchase was not used in any way to benefit the organization; it was for personal use of the individual. Does our organization have any legal grounds against this person?

Yes, it was embezzlement plain and simple. You can sue the person and have them criminally charged.

You can sue the merchant or otherwise not be liable to the merchant if it was clear to he merchant that the person did not have the authority to bind the organization...this however is hard to prove.
