Legal Question in Civil Litigation in North Carolina

My 16yr old son moved to NC to live with his Father and he has been charged with sexual misconduct against his half brother that also lives in the home. He hasn't had to go to court yet but the Mother of the half brother has been calling me in SC & saying that she is going to file a civil suit against me and my current husband, my son, and my exhusband. Can she do this towards me since I do not live in the home or state where the alleged action took place? Also, he hasn't been found guilty of any crime yet. It all stems from her trying to get custody of her two children with my exhusband. She stated that if I could get my ex to give her both her children she would not do this. Thank you for any advice you can give. This is becoming a nightmare and on top of it all I'm having to worry wether or not we could loose our home.

Anyone can file a lawsuit, but she really has no viable claim against you or your husband. The only possible claim she could have, based on what you've mentioned, is filing on behalf of her son against your son for battery, assault, or whatever else she thinks might have been done. If she does sue you, you should hire a lawyer in NC in the county where the suit is filed.
