Legal Question in Civil Litigation in North Carolina

interrogatories

I received a set of 10 interrogatories that were attached to a Complaint. #1 asks me to state my full name and social security number.

Am I required to give this? What happens If I refuse?

Another interrogatory states as follows:

Identify, specifically, each and every document, writing paper, or letter which you intend to utilize as the basis or ground for any defense, or which you intend to offer as evidence in the trail. Please provide copies of such documents.

I feel that this interrogatory is unreasonable because there are documents out there which I am unaware of until my discovery is complete.

What are my legal options? Can I file a motion to extend time until completion of discovery, or a Motion to strike interrog?

Re: interrogatories

You will probably ultimately be ordered to produce your SS number, but you can probably get a protective order if you are concerned about that. The "discovery" process is broad, but you have some privacy rights also. You can probably get a 30 day extension to answer the interrogatories. The second interrogatory is may be invalid because it is too broad. In any event, you can (and should) supplement your interrogatory responses with any new information you obtain in the future, and you should be safe. You can also object to an interrogatory, and the issue could be argued in court. It sounds as if you are rapidly becoming involved in a more complex legal situation, and you may want to retain an attorney to assist you.
