If a married couple had seperate bank accounts nothing joint and 1 passes away cant the other spouse's account be frozen?

First, in NC, accounts can only be taken if a judgment has been obtained and creditors take specific actions.

If all debts are separate, then no, the account shouldn't be taken.

But some debts are joint when people don't realize it, such as tax debts when a joint return is filed or medical debts.,
