Legal Question in Employment Law in North Carolina

3yrs ago i got into trouble but i had the record expunged and i also received a letter stating that it was expunged however i recently applied for a job and they did a basic back round check and the record showed up, i contacted my criminal lawyer in the case and he said that the sheriff department did not complete their job and now i have to wait 3 months for my record to clear. Am i able to sue the sheriff department due to the fact that the sheriff department not doing there job and that being the reason i did not receive the job

This is not likely. There is a provision under the law called Soverign Immunity. This means that a government usually cannot be sued unless specific things happen.
